AN ACT
Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
Statutes, in weights and measures, further providing for
meter required.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 4180(a) of Title 3 of the Pennsylvania
Consolidated Statutes is amended and the section is amended by
adding a subsection to read:
ยง 4180. Meter required.
(a) Metered vehicle.--No person shall deliver light fuel
oils to any domestic consumer unless the vehicle by which such
light fuel oils are delivered is equipped with a meter of a type
capable of furnishing a printed delivery ticket approved under
provisions of Subchapter D (relating to device type approval).
Each meter-printed delivery ticket shall bear a printed
nonrepetitive serial number. All deliveries of light fuel oil to
[such] domestic consumers shall be made by the use of a meter
and a meter-printed delivery ticket rendered the [customer]

domestic consumer at the time of delivery or with the invoice.
For meters equipped with the capability of issuing an electronic
receipt, ticket or other recorded representation, the domestic
consumer may be given the option to receive the meter-printed
delivery ticket electronically in lieu of or in addition to a
printed delivery ticket. A seller or deliverer may not impose a
separate fee for domestic consumers to accept or receive a
delivery ticket by any method, including a meter-printed
delivery ticket or electronic version of the meter-printed
delivery ticket. The seller or deliverer shall maintain the
receipts for two years in an orderly and retrievable manner.

(c) Electronic delivery ticket.--
(1) An electronic delivery ticket may only be provided
to the domestic consumer if agreed to by the domestic
consumer and if the technology is available to the deliverer
of light fuel oils.
(2) The electronic delivery ticket shall contain all
information required under subsection (b).
Section 2. This act shall take effect immediately.
